什么是法治


跟全美的占领运动类似,Nashville从10月7日开始了占领Nashville活动。这里是它的官方网站。http://occupynashville.org/

那么他们主要的占领基地是靠近州政府的一个广场,见上图。晚上大家就在那里搭帐篷睡觉。白天起来举牌示威。慢慢地州政府就看不顺眼了,想了个办法。颁发了宵禁法令,说这个广场晚上10到凌晨6点不许有人。于是在10月27日,依照该法令,州警在上周末抓了滞留广场的近50多名示威群众。

Troopers Arrest Occupy Nashville Protesters

State troopers in Tennessee arrested dozens of Occupy Nashville protesters overnight. After giving them ten minutes to clear out of Legislative Plaza, officers took about two dozen people into custody without much incident. The state has issued a curfew barring people from the plaza between 10 p.m. and 6 a.m..

看上去,上述策略很有用。岂料,今天进一步的新闻就出来了。有一位联邦法官裁定田纳西州政府关于宵禁的法令是违宪的。他颁布另一项临时法令禁止州府依据宵禁令逮捕在广场睡觉的示威群众。美国公民联盟ACLU 的律师说州府的宵禁令违反了第一宪法修正案。

Nashville Judge Grants Restraining Order Preventing Arrests Of Protesters

Occupy Nashville protesters are regaining their right to camp out at the state capital. A federal judge has granted a temporary restraining order preventing the state from arresting protesters for violating a curfew ordinance at the capital. ACLU attorneys say the new restrictions are a violation of First Amendment rights. State troopers arrested around 50 demonstrators over the weekend.
